These Terms of Service ("Terms") are a legal agreement between you and Leasd Group LLC ("leasd," "we," "us," or "our") governing your access to and use of our website, web applications, mobile app, and related services (the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. What leasd is — and is not
leasd is a technology platform that connects renters, licensed real estate agents, and apartment communities. leasd is not a real estate broker and does not provide real estate brokerage services. Any brokerage services are provided solely by independently licensed Texas real estate agents who use the platform. leasd is not a party to any lease, rental agreement, tour, or transaction between renters, agents, and properties.
leasd does not own, manage, lease, or control any property listed on the platform. We do not endorse or guarantee any property, agent, renter, or listing.
2. Eligibility and accounts
You must be at least 18 years old to use the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to keep it current.
3. Property information is not guaranteed
Pricing, availability, floor plans, specials, photographs, amenities, and other listing details are provided by property managers or third parties and are subject to change at any time without notice. leasd does not independently verify this information and makes no representation or warranty as to its accuracy, completeness, or availability.
You must independently confirm all property details — including rent, fees, availability, lease terms, and unit condition — directly with the property before making any decision or entering into any agreement. Any reliance on information displayed in the Services is at your own risk.
4. No professional advice
Information provided through the Services, including any AI-generated matches, recommendations, or summaries, is for general informational purposes only and does not constitute legal, financial, tax, or professional real estate advice. AI-generated content may contain errors and should not be relied upon without independent verification.
5. Agent subscriptions, automatic renewal, and cancellation
Licensed agents may subscribe to leasd Pro for a recurring subscription fee of $99 per month (unless a different price or promotional rate is shown to you at checkout). By subscribing, you authorize us and our payment processor (Stripe) to charge your payment method on a recurring monthly basis.
Your subscription automatically renews each month and continues until you cancel. You may cancel at any time from your account settings or by emailing partners@leasdapp.com. Cancellation takes effect at the end of your current billing period, and you will not be charged for the following period. If a payment fails or a subscription is cancelled, access to Pro features may be suspended; your account data is retained and access is restored upon renewal. Fees already charged are non-refundable except as required by law. We may change pricing on a going-forward basis with advance notice.
6. Referral fees
Properties listed on leasd may agree to pay a referral fee when a renter referred through the platform signs a lease. Any such arrangement is between leasd (or the applicable licensed agent) and the property, and is governed by separate agreement. Referral fees do not create any obligation owed by renters, who never pay leasd.
7. Acceptable use
You agree not to:
- Use the Services for any unlawful, fraudulent, or discriminatory purpose;
- Violate the Fair Housing Act or any anti-discrimination law (see our Fair Housing Notice);
- Submit false, misleading, or infringing content;
- Scrape, reverse-engineer, or interfere with the Services;
- Access another user's account or data without authorization;
- Use the Services to harass, abuse, or harm others.
8. User content
You retain ownership of content you submit (such as property photos and listing details), but you grant leasd a non-exclusive, worldwide, royalty-free license to host, display, and use that content to operate and promote the Services. You represent that you have the rights to any content you submit and that it does not infringe third-party rights.
9. Disclaimer of warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. LEASD DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY INFORMATION (INCLUDING PROPERTY LISTINGS) IS ACCURATE OR COMPLETE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEASD AND ITS OWNERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEASD'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID LEASD IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
LEASD IS NOT RESPONSIBLE FOR THE ACTS OR OMISSIONS OF ANY AGENT, PROPERTY, RENTER, OR THIRD PARTY, OR FOR ANY DISPUTE, LEASE, OR TRANSACTION BETWEEN THEM.
11. Indemnification
You agree to indemnify and hold harmless leasd and its owners, members, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your content, or your violation of these Terms or any law.
12. Third-party services and links
The Services may link to or rely on third-party services (such as payment processors and external websites). leasd is not responsible for third-party services and their use is governed by their own terms.
13. Termination
We may suspend or terminate your access to the Services at any time, with or without cause or notice. You may stop using the Services at any time. Sections that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will survive.
14. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Dallas County, Texas, and you consent to their jurisdiction.
15. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date. Your continued use of the Services after changes take effect constitutes acceptance.
16. Data security
We protect your data — and your clients' data — with industry-standard safeguards, including encryption in transit (TLS) and at rest (AES-256), database-level access controls that isolate each agent's data so only that agent can access it, and no storage of payment card numbers (payments are processed by Stripe) or Social Security numbers. See our Privacy Policy for details. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential and for the accuracy of the client information you enter.
